To the maximum extent permitted by applicable law, ErinToday and its directors, officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, loss of data, business interruption, or reputational harm, arising out of or relating to your use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, ErinToday’s total liability for any claim arising out of or relating to the Service or these Terms will be limited to the lesser of: (a) the amount you paid to ErinToday for the Service in the 12 months preceding the event giving rise to the claim, or (b) 100 EUR.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

8. Indemnification

You agree to indemnify, defend, and hold harmless ErinToday and its directors, officers, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service, (b) your violation of these Terms, or (c) your violation of any applicable law or the rights of a third party.

The Service may reference or discuss third-party technologies, standards, or organizations as part of educational content. If the Service includes links to third-party websites (when available), such links are provided for convenience and informational purposes only. ErinToday does not control and is not responsible for the content, policies, or practices of third-party websites or services.

11. Governing law

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of Ireland, without regard to conflict of laws principles. Subject to the dispute resolution section below, the courts of Dublin, Ireland will have exclusive jurisdiction.

12. Dispute resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us and providing a brief written description of the issue and the relief you seek. We will make a good-faith effort to resolve the dispute within 30 days of receiving your notice.

If we cannot resolve the dispute within 30 days, either party may initiate proceedings in accordance with the governing law and jurisdiction clause above.

13. Termination

ErinToday may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk for other users, attempted to compromise security, or used the Service unlawfully.

Upon termination, the license granted to you to use the Service will immediately end. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and Contact.

14. Modifications

We may modify these Terms from time to time to reflect changes to the Service, legal requirements, or operational practices. Updated Terms will be posted on this page and will become effective 14 days after posting unless a shorter timeframe is required by law.

If you continue using the Service after the effective date of updated Terms, you accept the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
